Wills, Trusts and Successions

The Law Office of Alvin J. Dupre, Jr. assists clients in the development and implementation of comprehensive lifetime estate plans that carefully balance personal and administrative concerns. In addition to estate planning, we also assist clients with Successions. The firm strives to preserve the clients' current income and assets, minimize adverse consequences and insure the optimum financial benefit for present and future generations by utilizing a variety of tax saving instruments, including:

  • Wills
  • Testamentary trusts
  • Living Trusts
  • Life insurance planning
  • Beneficiary designations
  • Powers of Attorney

Although there are no laws that require the assistance of an attorney is estate planning, there are good reasons to hire an attorney with experience in estate planning. Here are a few:

A generic form will or trust has probably not taken into account the legal requirements of Louisiana. It also will not take into account the individual wishes of the drafter. In the long run, a "do-it-yourself" will or trust may be more expensive than consulting a lawyer. For a trust to be effective it takes more than simple drafting: the assets must be transferred into it. Without proper legal assistance, all of the tax benefits of using a trust can be lost.

Ignoring the issue of estate planning will result in your estate being distributed by the probate court in the manner imposed by law. You will have no say in how you estate will be distributed or who the administrator will be. Although you may think that it will all pass to your spouse, depending on the size of the estate, your spouse may get slightly more than half with the rest being held by a guardian for your children. If you want to direct the passing of your assets at death, name an executor, and keep taxes and expenses to a minimum, you need to look into estate planning with an experienced attorney.

Real Estate

The Law Office of Alvin J. Dupre, Jr. represents developers, owners, property managers, tenants, financial institutions and investors in all types of disputes, including those arising from:

  • Acquisitions
  • Brokerage commissions
  • Construction contracts
  • Foreclosures

  • Leases
  • Property management
  • Adverse possession
  • Boundaries
  • Easements
  • Rights of way

In addition to representing clients in litigation, the firm serves as counsel in real estate closings. Alvin J. Dupre, Jr. is a Licensed Title Insurance Agent. No only is he well aware of title-related problems that arise during the sale of property, he can write property title insurance policies.

Construction Litigation

The Law Office of Alvin J. Dupre, Jr. has acquired an in-depth appreciation of the issues which typically arise in construction-related disputes and the facts and law material to their resolution from the firm's years of experience representing residential and commercial owners, developers and contractors. The firm has litigated claims in both courts and arbitrations involving compensation for "extra work," defective construction, defective building products, statutory and contractual warranty claims, delay damages, mechanic's liens, insurance issues and indemnification. In doing so, the firm has established relationships with individuals and firms who provide services, where necessary, as expert witnesses.

As compared with other areas, alternative dispute resolution or arbitration may be appropriate in construction-related matters, even in those instances where a standard AIA contract--which specifically provides for arbitration--is not involved. Because such disputes typically involve alleged deficiencies with more than one trade's work, and because the work of one trade often impacts the quality and timing of another trade's work, an arbitrator with specialized knowledge can help to reduce the time spent in trial and the cost associated with expert witnesses. The Law Offices of Alvin J. Dupre, Jr. will recommend that the appropriate alternative dispute mechanism be employed where appropriate and in its client's best interests.

Plaintiff's Personal Injury and Wrongful Death - Car Accidents

Victims of car accidents are entitled to compensation for property damage (car and motorcycle repairs), medical bills, lost wages, pain and suffering and permanent injury or disfigurement. Adjusters and insurers have one set of procedures for handling claims by individuals not represented by an attorney and a different set of rules for claims in which the victim has an attorney.

While car accidents comprise a significant portion of personal injury and wrongful death claims, it would be wrong to think that they are always simple to resolve. The firm understands not just the "rules of the road" and the special duties imposed on commercial and public carriers, but also the complex scientific and engineering principles often necessary to unravel just how an accident occurred on the roadways of Louisiana and who, if anyone was at fault. The firm handles accident cases involving:

  • Rear end collisions
  • Intersection accidents
  • Alcohol related crashes
  • Hit and run
  • Passenger injuries
  • Driver injuries
  • Motorcycle accidents
  • Pedestrian accidents
  • Bicycle accidents

Even after deducting attorney fees, the net recovery for an individual who is represented by an attorney will be greater than an individual who tries to handle it alone. And the lawyer can handle everything, saving you the aggravation of dealing with impersonal, uncooperative and aggressive insurance adjusters. There are other hidden dangers in handling your own claim. You may not even be aware of additional levels of insurance coverage, coordination of benefits and subrogation issues that allow you to keep more of your settlement.

From routine fender benders to catastrophic cases, it makes sense to retain an expert legal advisor.
